General


These Terms and Conditions ("Terms") govern the services provided by Cherished Keeps ("we," "us," or "our") related to custom laser engraving and customized apparel. By placing an order or utilizing our services, you ("Customer" or "you") agree to be bound by these Terms.

1. Order Acceptance and Cancellation

  • Order Confirmation: All orders are considered finalized only after we have received full payment or a pre-approved deposit and the final artwork proof has been approved by the Customer.
  • Order Acceptance: We reserve the right to accept or decline any order for any reason, including the inability to engrave the requested design on the chosen material, or if the design violates our content policy (Section 3).
  • Cancellation Policy:
  • Before Production: If an order is canceled before any production or material sourcing has begun, a full refund, minus a 10%  administrative/design fee, will be issued.
  • After Production Begins: Once materials have been engraved, cut, or apparel has been printed, the order cannot be canceled, and no refund will be issued.

2. Pricing, Payment, and Production

  • Pricing: All prices are subject to change without notice but will be confirmed on your final invoice. Quotes are valid for 30 days
  • Payment: Full payment is required upfront for all orders under $250. For orders exceeding this amount, a 50 % non-refundable deposit may be required to begin production, with the balance due upon completion and prior to shipping/pickup.
  • Production Time: Production times are estimates and begin only after final payment and artwork approval have been received. We are not liable for delays caused by material shortages, equipment failure, or shipping carrier issues.

3. Design and Artwork

  • Customer Responsibility: The Customer is solely responsible for the accuracy of all artwork, spelling, dates, layouts, and sizes provided to us. We will provide a final digital proof for approval. Production will not commence until this proof is formally approved by the Customer.
  • Proof Approval: The Customer's approval of the proof signifies acceptance of the design exactly as shown, including placement, sizing, and spelling. We are not responsible for any errors or omissions discovered after proof approval.
  • Content Policy: We reserve the right to refuse to produce any design that is deemed offensive, illegal, defamatory, hateful, or violates third-party intellectual property rights.
  • Artwork Quality: The quality of the final engraving or print is directly related to the quality of the artwork provided. Low-resolution or poor-quality files may result in a substandard product. We will advise the Customer if the artwork is deemed unsuitable.

4. Materials and Engraving/Printing Results

  • Natural Materials: For products made of wood, slate, leather, or other natural materials, slight variations in color, grain, texture, and engraving depth are inherent and normal. These variations are not considered defects.
  • Apparel Sizing and Color: Apparel colors shown digitally may vary slightly from the physical item due to screen settings. The Customer must consult the provided sizing charts, as we are not responsible for incorrect sizing ordered by the Customer.
  • Laser Engraving Process: Laser engraving on some materials (e.g., wood, leather) may result in minor charring or scorching near the edges of the design. This is a normal part of the process and contributes to the rustic look.

5. Returns, Refunds, and Claims

  • Custom Nature: Due to the personalized and custom nature of our products, all sales are final. We do not accept returns or offer refunds unless the product is defective or the error was made by us.
  • Our Error: If the final product differs significantly from the approved proof due to an error on our part (e.g., incorrect spelling, wrong material, or incorrect placement not matching the proof), we will, at our sole discretion, either reprint the order or issue a full refund. Claims must be submitted within 10 days of receipt of the order.
  • Shipping Damage: If your order arrives damaged, you must notify us immediately and provide photographic evidence of the damaged product and the shipping box. We will assist you in filing a claim with the carrier.

6. Intellectual Property

  • Customer Warranty: By submitting artwork, the Customer warrants that they have the necessary rights, licenses, and permissions to use and reproduce the intellectual property (IP) contained within that artwork.
  • Indemnification: The Customer agrees to indemnify and hold harmless [Your Business Name] against any and all claims, costs, and expenses, including attorney's fees, arising out of the use of copyrighted or trademarked artwork provided by the Customer.
  • Our IP: All designs, templates, and patterns created by [Your Business Name] remain our exclusive property unless otherwise agreed upon in writing.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Placing an order

Delivery


We are dedicated to delivering your custom items promptly and securely. Since all of our products are personalized, please be sure to account for our Production Time (see note below) alongside the carrier's transit time.


We collaborate with leading carriers (UPS, FedEx, and USPS) to provide a variety of shipping options that cater to your needs and budget.


Production Time: Keep in mind that all custom items require 3-5 days for production before shipping can commence. The estimated transit time begins once the package is picked up by the carrier. 

Example: An order dispatched using 2nd Day Air shipping will reach you in 2 business days PLUS the production time.


Tracking: A tracking number will be sent to you via email as soon as your order has been dispatched.


Shipping Costs: Shipping fees are calculated at checkout based on the package’s weight, dimensions, your location, and the service level you choose.


Carrier Liability: After the package leaves our facility, the carrier becomes responsible for its delivery. We cannot be held accountable for delays caused by weather, carrier complications, or incorrect addresses provided by the customer.
